State Invites Comment on Adult Day Settings

Ohio has posted for public comment a summary of the state’s observations for eight adult day settings that will be submitted to Centers for Medicare and Medicaid Services (CMS) for a heightened scrutiny review. They are inviting public review/comment through July 15, 2018.

 

The purpose of this posting is to provide public notice and receive comments on eight non-residential settings that may furnish the adult day health service in the NF-based LOC waivers. These settings are being submitted to CMS for heightened scrutiny review. The state has determined there is sufficient evidence to demonstrate these settings possess the required home and community-based characteristics and do not have institutional qualities.

 

The heightened scrutiny process and public comment period are requirements under the CMS Home and Community-Based Services (HCBS) Settings Final Rule (CMS 2249-F/2296-F), which sets forth the actions Ohio will take to operate all applicable HCBS programs in compliance with the final rule. States are required to give notice and to provide a 30-day public comment period.
